Terms & Conditions

Drain Saver, LLC
Effective Date: January 1, 2026

1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the services provided by Drain Saver, LLC ("Drain Saver," "we," "us," or "our"), including sewer repair, septic services, emergency response, and large-scale water mitigation services, as well as your use of our website at www.drainsaverllc.com.
By contacting Drain Saver, scheduling a service appointment, permitting our team to access your property, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you are agreeing to these Terms on behalf of a business, household, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Services Provided
Drain Saver, LLC provides the following services to residential and commercial property owners in Wray, Colorado and the surrounding Eastern Colorado region:

24/7 emergency sewer and septic response
Sewer camera inspections and diagnostics
Sewer line repair and full replacement
Roto rooting, hydro-jetting, and descaling
Septic system installation, pumping, and maintenance
Scheduled annual sewer and septic maintenance
Large-scale water mitigation and flood response
Preventative diagnostics and infrastructure inspection

Services Not Provided
Drain Saver specializes exclusively in sewer and septic systems. We do not provide general plumbing services, including faucet repair, water heater installation or repair, fixture replacement, or general pipe work unrelated to sewer or septic systems. Scheduling a service call for work outside our area of specialization may result in the call being declined or redirected.
Drain Saver reserves the right to decline, modify, or discontinue any service offering at any time without prior notice.

3. Scheduling & Emergency Response
Drain Saver operates 24 hours a day, 7 days a week for emergency sewer and septic response. Our standard emergency response window is within 24 hours of initial contact. Response times are estimates and may vary based on service volume, weather, geographic location, or other circumstances beyond our control.
Triage and Prioritization
Emergency service calls are triaged and prioritized based on urgency, not call order. Situations involving raw sewage entering a home, complete loss of sewer function, or imminent structural risk will take priority over less critical requests. We will communicate estimated arrival windows via phone or text and will notify you of any changes.
Arrival Windows
For non-emergency appointments, you will receive a text notification approximately one hour before our technician arrives. If we need to adjust your window, we will contact you promptly to reschedule.

4. Estimates & Pricing
Drain Saver is committed to transparent, honest pricing. We will provide a cost estimate before commencing any work. No billable work will begin without your verbal or written authorization.
If, during the course of work, we discover conditions that materially affect the scope or cost — such as additional root intrusion, pipe collapse beyond the assessed area, or unforeseen underground obstructions — we will stop work, explain what we found, and provide an updated estimate before proceeding.
Diagnostic or service call fees may apply for assessments, camera inspections, or site visits. Any applicable fees will be communicated prior to the visit.
We do not charge hidden fees. All costs, including labor, materials, and applicable taxes or disposal fees, will be disclosed in your estimate.

5. Payment Terms
Payment is due upon completion of work unless a separate arrangement has been agreed upon in writing before work begins.
We accept cash, check, and major credit and debit cards. Accepted methods are subject to change — please confirm when scheduling.
Invoices not paid within 30 days of the service date may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by Colorado law, whichever is less.
If you believe there is an error on your invoice, you must notify us in writing within 10 business days of receipt. Undisputed portions remain due and payable by the standard due date.

 

6. Warranty
10-Year Warranty on Major Repairs
Full sewer line replacements and complete new septic system installations performed by Drain Saver, LLC are warranted against defects in workmanship and materials for ten (10) years from the date of service completion. If a warranted repair fails due to our workmanship or materials within this period, Drain Saver will return and repair the issue at no additional charge.
Warranty Exclusions
This warranty does not cover:

Damage caused by events outside our control, including soil movement, seismic activity, extreme weather, flooding, or acts of nature
Damage caused by third-party contractors, unauthorized modifications, or improper use after our service
Normal wear and tear, including recurring tree root intrusion where root removal was not included in the original scope
Pre-existing conditions not addressed in the original repair scope
Manufacturer defects in materials or components, which remain subject to the manufacturer's own warranty
Routine maintenance services, jetting, pumping, or diagnostic-only calls

Warranty Claims
To submit a warranty claim, contact Drain Saver at the information in Section 12. We will respond within 3 business days and schedule a site visit as soon as practicable.

7. Limitation of Liability
Drain Saver, LLC carries general liability insurance and performs all work in accordance with applicable Colorado state codes and industry standards.
To the maximum extent permitted by applicable law, Drain Saver's total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim.
Drain Saver shall not be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of income, costs of temporary housing, or damage to personal property not directly caused by our negligence.
Drain Saver is not responsible for damage resulting from pre-existing conditions not disclosed prior to our assessment, or that arise as a natural consequence of sewer or septic repair work such as excavation.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be limited under applicable law.

 

8. Property Access
By scheduling a service appointment, you authorize Drain Saver, LLC and its employees and subcontractors to access your property at the agreed-upon time. You represent that you have the legal authority to grant such access.
You agree to provide safe, unobstructed access to relevant areas including cleanouts, crawl spaces, basements, yards, and septic system locations. Failure to provide safe access may result in the appointment being rescheduled or cancelled.
Prior to any excavation, Drain Saver will request utility locates as required by Colorado law. You agree to disclose any known underground utilities, irrigation systems, buried cables, or other underground infrastructure before work begins. Drain Saver is not liable for damage to undisclosed underground infrastructure.

 

9. Cancellations & Rescheduling
Cancellations with at least 24 hours' notice will not incur a fee. Cancellations with less than 24 hours' notice, or failure to provide access at the time of a scheduled appointment, may be subject to a service call fee.
Drain Saver reserves the right to reschedule appointments due to weather, equipment issues, staffing emergencies, or other unforeseen circumstances. We will contact you as promptly as possible to reschedule.
Due to the triage-based nature of emergency dispatch, exact arrival times for emergency calls cannot be guaranteed. If a higher-priority emergency causes a delay, we will contact you with an updated estimated arrival time.

 

10. Disputes & Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions.
Before initiating any formal dispute, we ask that you contact us directly to resolve the issue informally. If informal resolution is not possible, any dispute arising from these Terms or our services shall be resolved in the appropriate courts of Yuma County, Colorado.

 

11. Changes to These Terms
Drain Saver, LLC reserves the right to update these Terms at any time. Changes take effect upon posting to our website with an updated effective date. Continued use of our services following any changes constitutes acceptance of the updated Terms.
